The Supreme Court today agreed to hear a petition filed by serial PIL Petitioner M L Sharma seeking an SIT probe and direction to the CBI to register FIR against Prashant Bhushan, Kamini Jaiswal, Indira Jaisingh and others alleging that they conspired to malign the the CJI.
Sharma today mentioned the petition before Justice Bobde today, who agreed to consider it for listing.
The petition, which also names advocates Vrinda Grover, Shanti Bhushan Nina Gupta Bhasin and Dushyant Dubey, refers to few media reports to state that the sexual harassment complaint by the former SC staff has been drafted by Bhushan and others in order to frame the CJI.
The petition prays that the CBI should look into their activities and they be barred from practicing before any court or filing PILs.
Sharma, who has a record of filing several PILS in controversial issues, was asked by the Court to pay cost of Rs.50,000 last December for filing a frivolous case.
Last week he had mentioned the matter before the CJI yesterday for urgent listing. But the CJI asked him to mention it before some other bench.
After that he made an attempt before the bench headed by Justice Arun Mishra, who also declined to entertain it.
On April 25, the SC bench of Justices Arun Mishra, R F Nariman and Deepak Gupta had appointed retired Justice A K Patnaik to probe the allegations raised by Advocate Utsav Bains that the sexual harassment allegations were a part of larger conspiracy hatched by corporates and disgruntled employees to frame the CJI.
Later, Justice Patnaik informed that he will await the result of the in-house enquiry on the allegations against the CJI before examining the conspiracy angle.
